Contractor Agreement

This Independent Contractor Agreement applies to every Tradesperson or driver ("you") who registers on TradeConnect. It is in addition to the Terms of Service, Cancellation & Refund Policy and Privacy Policy.

1. Independent business

You are an independent contractor running your own business. You are not an employee, partner, joint venturer or agent of TradeConnect. TradeConnect does not control how you do your work, set your hours, or guarantee any amount of work. You can accept or decline jobs, work for others, and use your own tools and vehicle. You have no authority to make promises or sign contracts on behalf of TradeConnect.

2. Licences, insurance and the law

• You must hold every licence, certification and permit required for your trade and location, and keep them valid. The licence number you give us must be true.
• You must carry commercial general liability insurance appropriate for your trade and any other insurance the law or your customer requires, such as vehicle insurance for drivers.
• You are responsible for workers' compensation coverage where the law requires it, for your own workers or subcontractors, and for following health and safety laws and building codes.
• You are responsible for registering for and charging GST/HST where required and for reporting and paying all your own income taxes and other contributions. TradeConnect does not withhold taxes from your payouts.

3. Your work

You are solely responsible for the quality, safety and legality of your work, for any materials you supply, and for fixing defects. Only accept jobs you are qualified and equipped to do. Be honest in quotes and hours, and agree extra work in the app before starting it.

4. Payments and fees

• You agree to be paid for jobs found through TradeConnect only through the app, and not to take customers off the app to avoid fees.
• TradeConnect deducts its commission and fees, which are shown before you accept a job or send a quote. Your earnings, fees and payouts are visible in the app.
• Payouts may be delayed, withheld or reversed while a dispute, refund or suspected fraud is being reviewed.

5. Cancellations

You agree to the Cancellation & Refund Policy. Cancelling or not showing up for accepted jobs can lead to warnings, withheld payouts and suspension.

6. Customer information

You may use a customer's name, address and contact details only to do and manage the job. You must not keep, share, sell or use them for anything else, and you must follow privacy laws.

7. Conduct and safety

Be professional and respectful. No harassment, discrimination, violence, theft, impersonation, or working while impaired. Report any safety concern or incident to us right away. We may ask you to complete verification checks and may suspend or end your account if you fail them or put anyone at risk.

8. Responsibility and indemnity

You are responsible for injuries, property damage and losses caused by you, your staff or your work. You agree to cover TradeConnect for claims, costs and losses arising from your work, your breach of this agreement, or your breach of the law, to the extent permitted by law.

9. Ending this agreement

You can stop using TradeConnect at any time after finishing jobs you have accepted. We may suspend or end your account for breaking these terms or to protect people. Sections that by their nature should continue (tax, liability, customer information, indemnity) continue afterward.

10. Confirmation

By accepting, you confirm that the information you gave us is true, that you hold the licences and insurance your work needs, and that you understand you are an independent business.
